Capitol One TOS change

"Now it appears the company has tried to lay the groundwork so it can ask about your Capital One account via your regular phone or cell with fake caller ID, text message, or fax "with any frequency" and even showing up unannounced at home or work, according to the Los Angeles Times."

Meaning that they can even show up at your house with no warning. This should be illegal.

Ah.., but you are an evil 1%'er. Who are you to deserve a credit rating like that? You shouldn't be able to get those kinds of rates on loans; it's discriminatory! What about the ones who don't pay their bills? They are people too you know, and deserve credit. Your 800 credit rating is an affront to everyone who didn't win life's credit rating lottery like you did. You didn't earn that! You are just one of the lucky ones being selfish and sucking up more than your share of good credit in the world. Your credit rating should be taxed!!! Yea!! 50 points, no 100 points of your credit should be taxed and given to those less creditworthy than you, who through no fault of their own look like bad credit risks because your lofty number is what makes them look bad. It's not their fault that your number is so high and makes them look so bad! No sir! What you are doing is probably racist too, because we all know that minorities can't get 800 credit ratings because the game is rigged by racists! You stole that credit rating from those who really worked for it! We know you did! Let's tax it and take it to punish you for your evil!! Power to the people!!!

The link in the OP doesn't work, but can I assume from the discussion in the thread that this change in the agreement with the company allows them access when your account is delinquent?

If that is the case (and please inform me if it isn't), has anyone here known how slippery debtors can be when they can't pay their bills? I can see why the company would seek to have better access, since they apparently take on a lot of high-risk people for their credit cards. They shouldn't be able to harass people, but people who owe them money shouldn't be able to just slink away from their debts.

YEA... Im a 1%er...My score is over 800... cant tell that by my bank account though.???

If your credit score is over 800, which puts you in the top 1% (oops, that makes us 1%'ers and a target for the left), you can get any credit you want, and will get the best rates. If do something big, say take out or refinance a mortgage, or buy a car on credit, your score will take a temporary hit of 10-15 points which lasts 6-9 months. Also if you buy a car on credit (i.e. an installment loan) your score will take a 10-15 point hit in addition to the above for the duration of the loan (the scoring program frowns on installment loans whereas it likes mortgage loans). To put that in context, being late with a payment can cost you 50 points per occurrence and lasts three years.

Not a problem for me personally, mudtoe, my lovely wife keeps me straight. I don't have a Capital One card and would not seek to get one, based on their "agreement". I use credit union credit and debit cards with good success and dividends. Lol, my wife was miffed when we bought a car recently and my credit score was 30 points higher than hers, since SHE does the bills! I told her not to worry about it since we were both in the 800's.

I actually have one of their cards because it pays 1.5% cash back on every purchase and has no annual fee, which is better than any other card out there. As I've never in my life been late with a credit card payment and always pay off the full balance every month, I don't have to worry about stuff like fees, interest charges, or collection agencies and their tactics. That said, as I noted below, there are ways to fight fire with fire if you are so inclined.

I read about this yesterday. Apparently they were trying to cover it by saying that they sometimes get misidentified by the phone company equipment. That's NOT what the legally binding contract says. They also said they would never come to your house or business, unless you bought a PWC or motorcycle that they were impounding. Hey, all I know is that with language like that in their cardholder agreement, they won't have me as a cardholder.

If people start closing their accounts they will get the message. I suspect that this is to allow collection agencies free reign to do what they like if you don't pay your bill. Of course, if you are smart and you know you aren't going to be able to pay your bill soon, before you get overdue you can just change your address, email, and phone number to something fake and send them off on a wild goose chase.
