I agree with BlackGumTree on the legal framework of the constitution. It would seem impossible to take the Oath of Office to defend and uphold the constitution while the state strips the constitutional rights from residents without the approval of the Supreme Court.

I found NYS definition of the assault weapon term. NYS Penal Law 265.00 #22. That’s theirs it’s to big to put in here. It looks like the people of NY are going to loose another constitutional right. It will not be the first one.

Good for you. You want an award or something?

Now, can you please explain the differences between this incident and Sandy Hook?

I know you can't, so I'll give you a couple of hints...

1) The perp didn't go in the station voluntarily. He was brought in handcuffed. He didn't go in the station on purpose to shoot innocent people like Lanza did. On the contrary, he thought he had an opportunity to get OUT of that station.

2) He managed to shoot 3 cops. I'm sure there were more in the building he could've shot if they hadn't had guns of their own. They did. He's now dead.

I'm sure that station (and others) are tightening up their procedures after this incident. It was definitely a mistake and sounds like Ms. Burns was either not the best choice for "processing" the perp (doesn't say anything about how big both of them were) or she was too close to him while he was being uncuffed.

Sissurf I think the New York laws that were rushed thru the assembly and senate in 2 days is far too excessive. It looks like it was done to be harsher that what Obama wants. These NY laws will bring in millions of dollars in fines and it will open up a new black market in the state. I looked at the senate bill that passed its quite large every violation is a felony and its set up so there are always more than one charge. It is the same as the police sitting in the bar parking lot and stopping every car that leaves the bar. It seems that no matter what you do if you own an ar15 or bushmaster .223 you will be fined. You have 30 days to register once you do the troopers will be at your home and inspecting everything and everyone who lives there. Its entrapment pure and simple. Up here in the north everyone is selling them as fast as they can look on facebook firearms group low prices $400 with every attachment and case they would take $200 cash, no one wants them. I don’t like point and shot there is no skill in it. I like a challenge.

I previously posted a story about an unarmed man brought into a police station (as a suspect) who subsequently acquired an officers weapon and shot 3 officers. No gun free zone there, you betcha.

Looks like Hiram_615's list is very similar to the one on this DailyKos page. As usual, the liberals try to twist the story as if "Gun Appreciation Day" was the culprit. At least the DailyKos page has links to each of the incidents (now numbering 91).

Here's a sample from #40 (#50 on the DailyKos list), in San Leandro, CA, which I picked just because I thought I could pinpoint the incident easily with a Google search:
"KTVU reported that the shooting was a result of two feuding gangs who met up at the station, got into an argument, and then began a shootout."

Yeah...that sounds like an NRA event, eh? Too bad members of the NRA weren't there at the time.

I've been thinking about some of the reactions here on my thread, especially from a die hard Democrats when it comes to accidents with a fire arm. To me the comments made here are more like a Hello Kitty incident. That is if these accidents really did happen at a gun show. As it was, there were no links to their stories. I've never heard of this happening before, so I can't help to wonder who's behind all these mishaps at a gun show lately. Sounds like a set up if you ask me.

Now I would be more interested if either MiddletownMarty or Hiram615 had some information as to how a gun show was being robbed. Or how some one was being held up for their money, or sexually assaulted at a gun show, etc., but that's not what they did. What they did was a Hello Kitty post. As marty would say, accidents do happen, get over it!

Ever wonder why..

You do not hear about armed men forcing their way into a police station where everyone is armed? How about a military base? Perhaps a gun show? Yeah, those don't really happen often.. Schools, malls, movie theaters and restaurants are the favorite.. and imagine that.. they are all gun free zones in most cases.

After hearing this insane story this morning on the JR and Jen show..I wonder if they would consider a super soaker an assault rifle!

"The kindergartner was ordered to undergo a psychological evaluation during her 10-day suspension, which was later reduced to two days. The evaluation deemed the girl normal and not a threat to others, Ficker said."

"The suspension comes one month after the Sandy Hook Elementary School massacre, which has created a heightened sense of alert at schools across the country."

I don't know, I think you might want to check out your local gun stores in your area first before taking your father in law to a gun show. I heard there was nothing left at the Hampton Gun Show here in Virginia. Now the gun stores are all out! Let me know what you find in your state when you get the chance, thanks.

I hope everyone got the "rush to go to a gun show" out of their system this weekend. I plan on taking my father in law to a show this weekend and really don’t want to have to fight a crowed.

I still have the same question that I have had since 1994. What is an assault weapon? The items ban under the assault weapon ban make no difference in the function of the weapon. Most of the items listed in the ban reflect on the appearance more than the function. Examples are, a bayonet lug, a pistol grip, a flash suppressor and the ability to mount a barrel launched grenade launcher. The round capacity is also a feel good restriction because the magazine can be switched out in under a second. Even a revolver can be reloaded in about a second.

In my opinion any weapon pointed at me is an assault weapon, that includes a knife.

I'm not to sure about that, especially for future generations.

Today I went to two gun shops in Portsmouth, and was shock to see them both closed, even though a phone call that I made earlier, made it sound like they were open. The store even had the we are open sign in the window.

Interesting, isn't it?

I was wondering, those of you in other states, are you coming into the same problem of gun stores closings?

I support 2nd Amendment rights. But I don’t believe we need assault weapons anywhere near our children. A marksman with the m16 and over 20 years of military service one fact remains true. If anyone invades the USA there will be plenty of assault weapons laying around no need for them in our communities now.

Vatican gives blessing to Obama gun control proposal


The Vatican praised President Barack Obama's proposals for curbing gun violence, saying they are a "step in a right direction."

Vatican's chief spokesman the Rev. Federico Lombardi, said Saturday that 47 religious leaders have appealed to members of the U.S. Congress "to limit firearms that are making society pay an unacceptable price in terms of massacres and senseless deaths."

"I am with them," Lombardi said, in an editorial carried on carried on Vatican Radio, lining up the Vatican's moral support in favor of firearm limits.

''The initiatives announced by the American administration for limiting and controlling the spread and use of weapons are certainly a step in the right direction," Lombardi said.

They do not have the time to prosecute everyone that already breaks the law but yet they want to create more laws which means that even more people will break them and we are supposed to believe that this is going to help? Ok...

I celebrated by taking the NRA Basic Pistol training course.

In between classroom sessions, each student got to fire 10 rounds from a .22 Ruger semi-auto. I placed all my shots on the paper, but no bullseyes.

After the class, we were able to try out several handguns. I tried a 9mm S&S M&P Shield, a .45 Beretta and a large-caliber long-barreled revolver. Hit a bullseye with the .45. One student got to try a .50 Barrett, but at a cost of about $5/round the rest of us just got to watch (and feel the BOOM).

I may "celebrate" today's inauguration with the purchase of my first handgun.

The Executive Branch can't even do their own job, and that's before the new laws went into effect!

According to an interview that Baker gave with the Daily Caller, he said that Biden told him, “regarding the lack of prosecutions on lying on Form 4473s, we simply don’t have the time or manpower to prosecute everybody who lies on a form, that checks a wrong box, that answers a question inaccurately.”

Really now, and Biden wants honest citizens to do what?!

I haven't read all of the post on this topic but I have an observation.

After Obama was elected (or appeared to be able of winning the 2008 election), people were concerned he would take away our 2nd Amendment rights and you could not find ammunition or buy a hand gun or what people call an assault rifle. The result was a dramatic increase in gun ownership and ownership of ammo.

Newtown was a tragedy. With all of the calls for something to be done, America is back in that mind set. More guns and ammo have been bought since Newtown probably in history.

In my view, not including Newtown and Aurora and similar events, most of the guns used in violent crimes are obtained by the criminals when guns legally bought but inadequately secured are stolen in home burglaries and then sold on the street.

Gun owners need to be sure their guns are secure in their homes.

"A person is in stable condition at a northern Ohio hospital after being shot by his business partner at a gun show run by Conrad and Dowdell Productions, said Medina police Chief Patrick Berarducci.
The original owner of the Taurus semi-automatic 9 mm handgun used in the shooting brought the firearm into the show fully loaded. This is despite the policy of searches to make sure all guns are not loaded and rendered safe before others can handle them." (CNN)

Go to your local gun store, gun range, or gun show with a copy of the Constitution, their American Flags and “Hands off my Guns” signs.

And don't forget your body armor.

Strange. A gun show would be the furthest thing from a gun free zone in existence. I wonder why all the fear.

And passing up all that opportunity to sell guns and memberships. Tsk tsk.

Well I'll be!

I never did get my foot in the door of the gun show!

I have never and I mean "NEVER" seen such a crowd at any gun show in my life!

For the fist time, all the doors were locked. The security were only letting you in through one open door, all other doors were locked. They had so many security guards, never mind police officers, and to put icing on the cake, they had a Command Post. They never had a Command Post before! There were even fire trucks come to think of it.

I asked one couple with a infant how long they were waiting in line and they said, 25 minutes. I got a kick out of her, she even check her cell phone to make sure. I myself had to beg a security guard to let me inside, just to go to the powder room. Going to a gun show has never been so darn right crazy like this before! Even though the long wait, everything was calm. Thank God for a beautiful warm day, I say.

The bad point was, I, wasn't able to talk to the NRA or sign up. They were inside the building, where normally they are outside of the area signing people up. I would have needed a ticket to get in just to talk to them. That was a bad move on the NRA, I must say! They would have been rolling in the do-re-me, with all those people just standing in line for over an half an hour. I'm sure once the doors opened, guns and ammo was the only thing on people's mind at that point. Maybe I should send the NRA a little note on this issue, to help them out some more.

A - They are NOT my changes, they are changes proposed by many groups and politicians in the United States, AND the Department of Justice.
B - It only takes a stroke of a pen to bring these changes in, which would make it EQUAL for all.

If you have to be vetted to be allowed to buy a gun from a dealer, what makes you, or ANYBODY think requiring vetting of a person you sell the gun to somehow a violation of the Constitution?
Does the person who you propose to sell the gun to on a private basis somehow have greater Constitutional rights than you have when you buy the gun from a dealer?

Again, not MY proposal, it is a proposal of the DOJ, echoed by politicians and various other groups in the USA, and I have pointed out previously that proposals from the DOJ were shelved for convenience before the Presidential election.
For a mandated fee, it is proposed the checks would be run by licenced gun dealers.
There are are 9 classes of persons prohibited from possessing firearms:
1) persons convicted in any court of a crime punishable by imprisonment for a term exceeding 1 year;
2) fugitives from justice;
3) drug users, or addicts;
4) persons adjudicated mental defectives, or committed to mental institutions;
5) unauthorized immigrants;
6) persons dishonorably discharged from the Armed Forces;
7) U. S. citizenship renunciates;
8) persons under court-order restraints related to harassing, stalking, or threatening an intimate partner or child of such intimate partner; and
9) persons convicted of misdemeanor domestic violence
I suppose instead of having a check run when you sell a gun privately, or at a gun show that has no background check requirements, you could just ask the prospective buyer if he is on the list.
Yeah, who needs to check, nobody would lie to get a gun, right?

From the Almanac on Policy Issues:
"Federal law does not regulate gun shows specifically. Federal law regulating firearms transfers, however, is applicable to such transfers at gun shows.
Federal firearm licensees – those licensed by the federal government to manufacture, import, or deal in firearms – are required to conduct background checks on non licensed persons seeking to obtain a firearm from them, by purchase or exchange.
Conversely, non licensed persons – those persons who transfer firearms, but who do not meet the statutory test of being "engaged in the business" – are not required to conduct such checks."

rumble says: One of the changes proposed is background checks for EVERYBODY, in every state, at every gun show, for every private sale. This is an attempt to make it harder for prohibited persons to still buy a gun when a dealer runs a check and denies the sale.
DOJ proposed making files from the various state and law enforcement meshed so that some persons on a prohibited list don't fall through the cracks.

I really hope nobody thinks it is a good idea to protest those needed changes in the name of the Constitution.

at every gun show, well rum, here in Iowa that happens at all gun shows. Now private sales, how in the sam hill do you propose to make it harder and enforce any kind of a background check? In Iowa, all private sales of handguns have to also be NICS checked - but guess what? How in the sam hill do you think this gets enforced? So you sell your old 22 HR to your neighbor, did you run a NICS check on him? Did you even know you had to?
How many dayum criminals who buy guns from some dude on the street get NICS checked? How many of those criminals "fall thru the crack" because some guy like you sells his handgun to some dude on the street for $400?

There are already lows pertaining to this - they just don't do SQUAT - because they are not enforced and are dayum hard to enforce - surely you can see why. Stupid laws like are now being proposed by the potus won't do crap to a criminal or a guy like you who sells his old 22 to some dude - it just makes the potus feel important and pretend like he's doing his koolaid drinkers a big service.
