A Frisco, Texas man is facing some stiff penalties- all for telling motorists via a sign that there was a speed trap ahead.

According to KHOU, Ron Martin was arrested by Frisco police last October, and is now facing trial for his actions, which he says he has a First Amendment right to do. Frisco police cited him for violating the city's sign ordinance, which says the person holding a sign has to be on private property.

Martin has pleaded not guilty and asked for a February 21 trial date in Municipal Court.

Frisco police said its officers have seen Martin holding signs at least twice before, but other cities already warn drivers of traffic enforcement, he said.

The issue is bigger than a simple sign...

I think there was another recent court case where the police lost and it is a person's first amendendment right.

But then again, freedom of religion actually appears before speech, and America isn't often honoring that anymore...

Its a shame they can't do their jobs like going after lane changers across multiple lanes, or the speeding that goes on the side streets in the city. How about the knuckle heads driving with one or no head lights. Or the idiots that pick busy streets who do the reiving of engines and racing with their tires screaming in the middle of the nights. Or the kids playing their music so loud it wakes you out of a sound sleep. But a guy holding up a sign is ridiculous ! In so many ways, we wrecked your speed trap so now your going to get even! Childish in so many ways but after all you have a badge. You want to get the bad guys go do your da--- jobs and grow up!

The long arm of the law is reaching too far. Law enforcemnet should be going after serious crime, not petty stuff like freedome of speach.

I lived in Spokane, WA. for a few months one summer (mid to late 60's) near a busy divided roadway which had a speed trap set up. There were some little kids (10 years old or so) used to sell lemonade at the dividing point. Instead of having a sign stating lemonade 10 cents (or what ever it was) the sign said Radar Ahead, they made the 6 o'clock news one night. Things have sure changed since then or not.

Some cities have no other means of trapping motorists, I believe we have the right to have a sign up. But there is also the fact that in-attentive driving could cause a few accidents. Its a catch 22, we have some small towns that go over board on catching people doing things they feel they should not be doing. Instead of catching the real hazards out there on the road. Like the speeders, racing late at night,or in the suburbs like the one by us. He lost control chasing another kid and took out one of our towers and a tree. What I'am saying is this, there are more important things that the police could be doing instead of arresting a man with a sign!

I agree with PD... the issue is bigger than just a simple sign! Government must learn to tolerate FREE SPEECH even when it conflicts with their interests!

Hmmm... sign law or free speech, I think civil disobedience is called for if you, for reasons of idealism and if it basically doesn't hurt anyone, have the guts to make your point for free speech. In this case, I do think that this guy needs to do his time and move on. He broke a law, made his point and now needs to pay up. If he actually believes the sign law is wrong then he should continue to act on his beliefs but if he's just "sticking it to the cops" then he needs to cut it out. No rational citizen wants to diminish the effectiveness of our police force because the previous poster is right, the speeders just speed up after they pass the radar anyway.

I drive as if there are speed traps everywhere .Staying within 5 mph of the posted limits keeps you under the radar.

around here, technically you can get arrested for flashing your lights at oncoming traffic to warn of a speed trap.

As for first amendment to trumping laws, I have seen enough cases to know that it's not always the case.

sometimes it makes casual speeders think. Actually there a superb 30 second ad out right now in New Zealand that shows the effects of speeding and the mistakes that others make that can cost even a regular driver's life.

First amendment rights don't over-rule laws. He was on public property, the wording of the sign was irrelevant. Nobody is allowed to just put up a sign, temporary or permanent, just because they think it is free speech.
Plus, he was creating a distraction, another no-no.
He could have stood on private property, but, of course, if the private property was his, first amendment wouldn't be a defence against trespassing, either.
And think about it, he warns a speeder, the speeder slows down, what has he accomplished besides keeping him from being caught? Speeders just speed up again after the radar anyway!
Defending him is defending his breaking the law while aiding and abetting of lawbreakers!

He was billboarding on public property. The contents of the sign are irrelevant. He could have been holding a sign saying "Last Gas for 500 Miles", and he still would have been arrested.

The man violated no laws. Under the 1st Amendment, he has every right to hold a sign saying "speed trap" as he does saying "Welcome to Texas".

In Emporia, one of my guys was given a ticket for doing 56 in a 55 zone, yes ONE mile per hour over the limit as he was coming off of I-95 and joining RT-58. The vehicle was completely hidden under an overpass so nobody could see them as well.

This is an old article, but it really bothers me. The police have been using traffic enforcement for revenue generation for years, and there have been several cases where they have been shutdown for running unlawful speed traps here in Texas. I don't see how this is not protected by freedom of speech.

Man arrested for showing sign warning motorists of speed trap? You should be able to hold up a sign as long as it is safe to do so. A sign warning of a speed trap is Not something to be arrested for and you should Not have to be on private property to do so either.
There are other situations where a person holding up a sign to warn drivers of something wrong ahead is no problem. What about street signs, advertisement signs, billboards, on strike signs - Will Work for Food signs?

The speed trap warning sign was cutting into the cities revenue.
The police have to much time on their hands, so they do this instead?
There was another article about a woman getting arrested for holding up a speed trap ahead sign. *That was a year or so ago.
Drive vehicles with high mpg, are very safe, reliable, have a ‘reasonable’ cost and a good ‘value’ for the money.
The price of fuel at the pump is too high!
