On October 1, texting and driving became prohibited in Florida. To show you how serious Florida lawmakers are about texting and driving, if you're caught, you pay a whopping $30.

The new FL law says police must first catch you in another traffic offense; — texting is only a 'secondary' infraction, nothing you can be pulled over for on its own.

The Palm Beach Post reports that while you can’t type and drive, it’s still legal to thumb away at that message while stopped at a light or in a traffic jam. And even then, should the officer ask to see the phone in question, you’re not obligated to hand it over.

In Florida from 2010 through 2011, at least 85 crashes caused by distracted drivers turned fatal, according...

i'd make it $200 fine I've had to deal with a lot of dumb drivers that are driving 5 miles below the speed limit or can't maintain their lane cause of texting

They spen more money on their special project then stopping people for texting while driving. Why not use an unmarked car and follow up on call ins for texting . Waste more tax payers money on trying to figure things out instead of paying attention to the drivers on the road!:)

So far, police in a number of states have not been able to find too many people who are texting while driving though many are still likely doing the work. To help stop the harmful practice, the Department of Transportation has granted a $550,000 grant to discover better ways of catching it. Source: /auto-news/distracted-drivers-deadly-results/

The fine isn't painful enough to make much of a difference. Pull their license, then they can text all they want to while they walk.

When I see police and school bus drivers stop doing it, then I'll believe a higher fine is applicable.

And the officer and judge wages plus administration overhead most likely cost ten times the $30 fine.

How about $5,000 for the first offense, and the second offense would require a 50% payment of the current national debt.

While I am totally against texting while driving, I still wonder where the enforcement will go. Will they soon ticket and fine is for changing the station on our radio or for changing a cd? This is a slippery slope that we are heading down.

Should be $10,000 for 1st offense, $400,000,000,000,000,000,000 for the second offense, and God forbid, you get a third offense...you'd be required to pay the entire national debt in one lump payment or the government will swiftly cut off your head.

I agree. Many States have in the Law Books a rule that states that you must have two hands on the wheel when driving. This rule is easier too enforce, and would save the law makers time on adding more rules. PLEASE JUST ENFORCE THE RULES THAT ARE ALREADY THERE, AND STOP WRITING NEW ONES.

It should be a "primary" offense and the penalty should be a loss of license for a year. People who text while driving are too stupid and dangerous to be behind the wheel.

I agree that the law will be very difficult to enforce, especially in terms of getting a ticket! If you read the law very closely (found this law description on The Hogan Law Firms website /news/florida-texting-while-driving-law--the-hogan-law-firm.aspx ) you can see it is very open for interpretation (by law enforcement) but also has language that would allow a judge to implement a stiff penalty to someone who gets in a serious accident while texting and driving. It will be very interesting to see what judges do with this law and what kind of criminal cases emerge as a result.

Using hand held devices or engaging in other activities while driving increases the risk of unfortunate incidents ...... and thus should be banned.
