Funding for Virginia's transportation infrastructure planning has hit a sizeable roadblock.

James A Cales, Jr., a Portsmouth Circuit Court judge in Plymouth VA, has ruled that public-private partnerhips there, as defined by the state's Public Private Transportation Act of 1995, are unconstitutional. He said the 1995 law involves an unconstitutional delegation of power to the executive branch.

And that means you can't keep the fruit from that tree too. Cale ruled against proposed tolls on the Norfolk-Portsmouth tunnels under the Elizabeth River.

Cales ruled in Meeks v. Virginia Department of Transportation that the Virginia General Assembly went beyond its state constitutional authority in granting VDOT...

would be fine for tolls, if the money goes for paying off and maintaining the roads

Donatelo: sometimes... but the toll is SUPPOSED to be for paying off the construction cost of the roads.

Except that they don't usually remove the toll booths when the roads are paid for. They keep it going for the income, even though it costs the rest of us more to do it that way.

rjh: agreed, but at some point the roads are paid for. And then they should remove the booths, thus, lowering the overhead costs right there :)

Toll roads cost more to operate than non-toll roads.

You've got to pay for the infrastructure to collect the tolls. That drives the cost up.

W-Dan: yes, tolls should end, but as FL's toll roads have shown, they are a nice source of income and jobs. So why stop when the money is paid off?

I was living in Portsmouth in 1989 when they took down the toll booths. I was (pleasantly) surprised when they took them down, and wondered why they would give up a source of revenue no one was complaining about. As I recall, the law that authorized the construction of the tunnel required the tolls to cease after the collected tolls had paid for it. Such a change. Modern legislators--and the corporations they partner with--see tolls as an endless source of revenue.

If you impose tolls on roads then no tax payer monies should ever be used for those roads and if the roads fall into disrepair then those in charge should be held criminally responsible.

Don't know for sure but tolls are a good way to have users pay! I am sick of the government using my gas taxes to give train riders a discount!
