Two families in Johnson County are blaming fracking and earthquakes for damage to their homes. They have filed a lawsuit naming the controversial natural gas drilling process as the cause for cracking walls and shifting floors in their homes.

Resident Ed Specht has lived in his house for more than 20 years. And now, he says, it’s falling apart.

“It’s just literally sinking in the ground – cracking, breaking apart,” said Specht.

It wasn’t until recent earthquakes started shaking up his neighborhood in Alvarado that Specht’s home had problems. “Cracks in the walls, the doors won’t shut, the windows won’t raise…” Specht and his wife say fracking is to blame for the earthquakes, which are destroying their home.

That's true PDQBlues, and it works both ways too. When the plaintiffs agree to settle because they know they really have no case those are sealed as well. Same for insurance fraud, medical malpractice and on and on.

The real key is that there have been numerous suits, very few if any proven and most frivolous as this one likely will be found. We need serious tort reform to eliminate tying up the justice system with these greed cases and clear the dockets for the real crimes and legitimate cases. Unfortunately, that's the last thing lawyers want!

They are going to have a hard time proving their earthquakes were caused by fracking much less proving that the earthquakes were powerful enough to be responsible for causing the damage to their homes. I smell a rat trying to do a media end run here.

There have been many lawsuits against fracking corporations, but all the settlements have been sealed and thus the public is deprived of the truth of the health risks from fracking. Someday, the truth will be known and all the chemicals used in fracking for which the public is currently denied.

Without being able to show a geologic change in the surface and directly relate it to the fracking process, this case is going nowhere fast.

Two things are evident from this article, 1) the families need a lawyer who knows one day from the next without referring to a calendar and 2) refrain from placing anything, especially fingers, in a newly developed crack whether the finger fits or not.

Fracking Blamed In Lawsuit Filed By Families In Johnson County. It will be very hard to prove if it is from fracking or not. How long has it been since the houses were built, the history of the houses and how much they have shifted or settled, when the houses started moving and cracking, when the fracking started, any earthquakes felt or recorded, there are many many things to consider or a combination of many items together.
More fracking, more chance to pollute the surface and underground waters. Properly treat the fracking water so it can be released safely on the surface. Recycle water into the underground rocks fracturing Only if there are NO contaminates or pollutants injected into the underground water and rock system at the same time.
Anyone for flaming water from the kitchen faucet?
We need clean drinkable water and uncontaminated lakes and streams!
Drive vehicles with high MPG, are very safe, reliable, have a ‘reasonable’ cost and a good ‘value’ for the money.
The price of fuel at the pump is too high!

It couldn't be an aquifer underground that is causing it could it? Who is going to pay for a geologist to drill cores samples to see what is really under the house? If Specht wants to pay for core samples to prove it. I'll buy it. Most likely Hydraulic Fracturing (Fracking is a liberal slang for Hydraulic Fracturing) is not at fault.

Which came first? Fracking or earthquakes? Seems to me that this is a stupid argument. Like moving next to the airport and complaining about the noise. Shakespeare was right; first we kill all the lawyers!

The sad thing will be that even after the lawsuit is resolved, the question about what caused the problem won't be. Our legal system is not designed for the truth of an issue.

There could definitely be a cause and effect with facking and these minor earthquakes, but it will be hard to prove.

Doesn't surprise me due to the method they use. I am sure they will pay out and chalk it up to the cost of doing business. Cheaper to pay out then stop fracking.
