Texas’s bid to keep control of its own greenhouse gas permitting program was rejected by a divided federal appeals court in a decision that supports a takeover by the U.S. Environmental Protection Agency.

In a 2-1 ruling, the U.S. Court of Appeals in Washington said today that Texas, Wyoming, Peabody Energy Corp. and industry groups aren’t in a legal position to challenge federal rules governing the revision of state implementation plans, known as SIPs. The ruling follows the court’s holding last year that the EPA’s limits on greenhouse gas emissions are lawful.

The parties cannot show harm because “the permitting requirements are self-executing” under the Clean Air Act, U.S. Circuit Judge Judith Rogers wrote in a majority opinion joined by Judge David Tatel.

The government is on the road to taking over all things if possible. Talk about a "1984" situation. They tell us the gas to use, the lights to buy for starters of a whole list of take overs and the majority of the public says that is alright. For those that think it is alright think that this is just the start.

Actually, They ARE in a legal position through "interposition" or "nullification" of unconstitutional federal laws. But don't expect a federal Court to limit the federal government anywhere.

I don't blame Texas for their efforts.

You never know:
In a few short decades there may be a new divided United States, divided after multiple states revolt and secede from the union - a union called Washington that today acts more like a socialist kingdom. For the same reasons we revolted against King George III of England, the same history may repeat itself in America.

The courts and EPA are both out of control. Both need to be restrained. The EPA clearly oversteps its bounds. Regulating greenhouse gases is not within their authority.

Great, now the EPA has even more power than they ever needed. Their egos are so big and arrogance so extreme that they fair no man nor state. The EPA and IRS are having great joy in punishing Americans, especially conservatives or anyone who supposedly opposes Obozo.

Looking at the bigger picture:

Can anyone name for me any department, agency, or even panel of the United States central government (it's not 'Federal' anymore, look it up) that is even minimally competent? Can any of them actually do the task for which they were created? Except the DoD, they actually do know how to make war, kill people and break things.
