Builders of a proposed pipeline that could carry Canadian crude oil to Flanagan and on to a facility in Patoka have asked the state for permission to exercise eminent domain on portions of 148 land tracts it claims it needs for the project.

The petition filed Tuesday with the Illinois Commerce Commission seeks permission to secure easements on properties owned by people who have not reached agreements with Enbridge Inc. The company plans to build a 170-mile pipeline that will cross through eight Illinois counties.

Enbridge put the project, known as the Southern Access Extension Project, on hold in 2009, citing poor economic conditions.

It's highly understandable that landowners would oppose this oil pipeline running near or through their property.

The reason: This is happening in Illinois. The president will protect the citizens of this state before any other or at the cost of any other.

Thank goodness that eminent domain laws on the books protect both parties.

I have participated in many ED cases and have come to realize how much these laws protect the landowner and mandate just compensation to the landholder.

In almost every case that goes to a hearing it is clear the landowner is simply holding out for nothing more than a bigger than fair market value for the compenstation for an easement on their land.

Eminent domain has been a favorite ploy used by big industries since the railroads got the government on board back in the 19th century. Now it's even used by developers to grab land for shopping malls. It'll keep on until people get fed up and stop it.

Eminent domain is only good for the receiver and should be abolished unless its for National security
