MORA — In a split vote on Monday, the Mora County Commission approved a community water rights and self-government ordinance, becoming the first county in the United States to permanently ban oil and gas drilling.

Roughly half an hour after the vote, the Pennsylvania-based Community Environmental Legal Defense Fund, which helped draft the ordinance, touted the victory in a news release.

“Existing state and federal oil and gas laws force fracking and other extraction activities into communities, overriding concerns of residents,” CELDF Executive Director Thomas Linzey said in the release. “Today’s vote in Mora County is a clear rejection of this structure of law which elevates corporate rights over community rights, which protects industry over people and the natural environment.”

FROM THE ARTICLE:

Mora County issued a news release of its own, announcing its approval of the ordinance.
The county’s release states that Mora is following the lead of more than three dozen municipalities on the east coast, including the city of Pittsburgh.

“It’s time for all communities to do what we’ve done — announce the end to extractive activities that threaten our land, our water, and our way of life,” Olivas said in the release. “If the federal and state government won’t do it, we must.

The people and lands of our own communities must come first, not the profits of gas and oil corporations.

It is interesting to read the quote of the Community Environmental Legal Defense Fund (CELDF) fund executive director touting the "win" for community rights over corporate rights in that this county ordinance, if indeed valid and enforceable, completely stomps on the rights of the owners of mineral rights under all of the land within the county. One would think that the rights of the individual mineral rights and land owners would be paramount over the "rights" of the county.

Predominately rural Mora County is one of the poorest in the state, and is steeped in the traditions of the Northern New Mexico Hispanic agricultural lifestyle. To them, water is life itself and they can't be blamed for preserving a way of life that dates back over 300 years.

Corporations AND communities are both made up of "people". And "rights" are conferred on individual people, not groups, so this statement (Captioned above) is pure nonsense. But you need to respect the rights of people; especially when they have spoken as a community. THIS is where a government most represents her people.

The federal government has no authority to speak to this issue, however, States and local governments do. Like it or not, Mora County, NM, has spoken and they will live with this decision, whether it's good or proves to be otherwise.
